The fact that he called it "witness testing" makes it even MORE absurd that he wasn't charged. This is basically an admission. The fuck would "witness testing" even mean, if not just an alternate way of saying "witness tampering"? If he was going to lie, why not just say something like "what? I was just genuinely wondering if his wife knew; there was no implicit threat." An obvious lie but still better than an admission.

Blackmail is the act of threatening another person with releasing undesirable information if they do not follow demands. If the information is already released then it is not blackmail. At most it might be slander or libel. Now if it is possible to proof that he DID threaten to release the information and this is how it was released then it is indeed blackmail.

For me it was working in a kitchen in high school and being the only English speaker. Suddenly all those lazy yet also dangerous immigrant complaints my parents had seemed insane. Then seeing them get berated by people like my parents really broke me out of the thinking I was raised with.
