Not that he was allowed. The Special Counsel does not have the authority, without congressional approval, to bring charges forward. This has never been a standard until today...so we'll see where that gets us, but SC Jackson already hinted he thought it was not constitutionally allowed.

The DOJ can appoint a special council without congress’ approval. There is precedent for this, as Trumps own Attorneys General, Bill Barr did exactly this. I dont know the exact legal terms, and DontKnowTheSource put it together quite well, but there's a whole slew of procedural issues that Cannon pretty much refused to deal with or set, with Jack having to explain how certain things work to the judge, essentially giving her a law lesson. Theres now enough stuff to have kicked off the case entirely and the circuit court really doesnt like having to deal with her bs, she's already be slapped more than once by them

Because with the current Supreme Court the law doesn’t mean what the law, even if in plain language, says. It means what the Supreme Court decides it means.

The law gave the Secretary of Education the ability to “waive or modify” student loan programs but apparently that doesn’t mean they can waive them because the Supreme Court said so.

The Congressional approval is needed only for the appointment of a Special Counsel. The Justice Department appoints an outside special counsel rather than just bringing the case themselves when they have a real or perceived conflict of interest. They can just bring the same case themselves...
